Understanding the Employment Act

Introduction
The Employment Act 1955 is a critical piece of labour legislation providing a comprehensive legal framework governing matters from payment of wages to maternity protection, employment of foreign employees and an employer's duty to notify Labour Office when starting a business and more.

This Act is primarily focused on employees who are earning less than RM1,500. It is to ensure that no contract of service between the employer and employee is less favourable than the provision under the Act.

This programme is meant to provide participants with a deeper and more comprehensive understanding of the Employment Act and the various sections that are crucial to employees during the course of their employment with an organisation.

After the two-day workshop, participants will be able to:

- understand the Employment Act within the context of the latest
amendments
- ensure competency in compliance to the requirements of the law
and contract
- understand their rights
- fulfil their obligations
- avoid costly consequences

Wages
- When to pay wages, how and where
- Loans to employees and deductions from wages
- Liability to principals and contractors

Protection of Women
- Night work for women
- Maternity benefits - who is entitled and how much
- Sickness following maternity leave

Rest Days
- Rest days for: normal and shift work
- Normal and overtime work on rest days
- Rest days during sick leave and public holidays

Hours of Work
- Definition
- Determining normal hours
- Shift work (how to schedule)
- Overtime work (requirements and limits)

Public Holidays
- Compulsory, non-compulsory holidays and additional holidays
- Requirement to work, substitution during rest days, sick leave or
annual leave
- Absence before or after public holidays

Annual Leave
- Eligibility and method of granting leave

Sick Leave
- Eligibility (with or without hospitalisation)

Methodology
Participants are guided through practical steps of the topic with a combination of lectures, case studies, and group discussions.
